Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of OrbitCAD, operated by Aldo Hernandez. By accessing or using OrbitCAD, you agree to these Terms. If you do not agree, do not use the service.

Service Description

OrbitCAD is an AI-assisted mechanical CAD platform that can interpret design prompts, generate and display three-dimensional geometry, and provide files such as STEP and STL exports. Features, supported part types, usage limits, and output formats may change over time.

AI-Assisted Outputs and Engineering Limitations

OrbitCAD uses automated and AI-assisted systems. Generated models, dimensions, calculations, recommendations, previews, and export files may be incomplete, inaccurate, unsuitable, or contain errors. OrbitCAD does not provide engineering certification, professional engineering services, manufacturing fitness determinations, regulatory approval, safety certification, or guaranteed accuracy.

You are solely responsible for independently reviewing and validating every design and output before relying on it, manufacturing it, incorporating it into another product, or using it in any safety-related or regulated context. Qualified engineering, manufacturing, safety, and regulatory professionals should be consulted when appropriate.

Subscriptions and Automatic Renewal

OrbitCAD may offer automatically renewing subscriptions, including access to premium features or export capabilities. The subscription price and billing period are shown before purchase. Unless canceled, a subscription automatically renews at the end of each billing period and Apple will charge the payment method associated with your Apple Account.

Purchases made in the iOS app are billed through Apple. You can manage or cancel a subscription in your Apple Account settings. Cancellation takes effect at the end of the current paid billing period unless Apple states otherwise. Deleting the app does not cancel a subscription.

Export Credits and Consumable Purchases

OrbitCAD may sell consumable credits for individual STEP or STL exports. Export credits are associated with the app account or anonymous session recognized by OrbitCAD and are consumed according to the purchase description presented in the app. Consumable purchases do not automatically renew. Credits have no cash value, cannot be transferred by users, and are not a guarantee that every requested model or export can be generated successfully. OrbitCAD or its purchase systems may reconcile credits between session identifiers when needed to restore or transfer a purchase entitlement.

Billing and Refunds

Apple processes App Store billing, payment authorization, subscription management, and refund requests. Except when required by Apple’s policies or applicable law, purchases are final and refunds are not guaranteed. Refund requests for App Store purchases must be submitted to Apple.

Acceptable Use

You may use OrbitCAD only for lawful purposes. You may not use the service to violate law or third-party rights; create weapons, explosives, or systems intended to cause harm; bypass access, payment, export, safety, or technical controls; interfere with or overload the service; distribute malicious code; scrape or harvest the service; or attempt to reverse engineer or reproduce OrbitCAD’s proprietary systems except where applicable law expressly permits it.

You must have the necessary rights to any prompts, files, specifications, or other materials you submit.

Intellectual Property

OrbitCAD and its software, interfaces, branding, algorithms, geometry systems, documentation, and related technology are owned by Aldo Hernandez or applicable licensors and are protected by intellectual-property laws. Subject to applicable law and third-party rights, you retain rights in the original content you submit and in generated design outputs created for you. No ownership of OrbitCAD technology is transferred to you.

Availability and Service Changes

OrbitCAD may add, modify, suspend, limit, or discontinue features or the service at any time. Access may be interrupted by maintenance, network failures, third-party services, capacity limits, or technical problems. OrbitCAD does not guarantee uninterrupted availability or permanent storage of sessions, designs, credits, or generated files.

Disclaimers

To the maximum extent permitted by law, OrbitCAD is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, safety, or manufacturability. You assume all risk arising from your use of the service and generated outputs.

Limitation of Liability

To the maximum extent permitted by law, Aldo Hernandez and OrbitCAD’s service providers and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, manufacturing loss, property damage, personal injury, product failure, or third-party claims arising from or related to OrbitCAD or generated outputs.

To the maximum extent permitted by law, total liability for all claims relating to the service will not exceed the greater of the amount you paid for OrbitCAD during the three months before the event giving rise to the claim or USD $100. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

Termination

You may stop using OrbitCAD at any time. Access may be suspended or terminated if you violate these Terms, misuse the service, create legal, security, or operational risk, or fail to pay applicable charges. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and governing law, will survive.

Changes to These Terms

These Terms may be updated from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use after updated Terms become effective constitutes acceptance of the updated Terms.

Governing Law and Venue

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or OrbitCAD must be brought in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction and venue.
